Reason: large over-extended stem cracked out and hanging, blocking residents access to rear garden, tree in state of advanced decay, unbalanced crown, remaining 2 large stems also likely to collapse. Duty to replace applies. Informative A: the landowner has a duty to plant another tree of an appropriate size and species when a tree is removed in a conservation area because it is dead or presents an immediate risk of serious harm, ref. Tree Preservation Orders and trees in conservation areas guidance, para 121: Section 213 of Town & Country Planning Act 1990 (as amended). Informative B: replacement tree planting species suggestion such as pear, mulberry, medlar, hazel, quince (Cydonia oblonga), Cornus mas, crab apple, desert or cooking apple, Amelanchier, for wildlife, flood mitigation by reducing rain run-off and shade to reduce increasingly high summer temperatures due to climate change, planted in any suitable location in rear garden. Informative C: please retain safe standing stem or high stump of T1 and create habitat log piles with arisings for wildlife and biodiversity.
